Supreme Court stays HC relief to Katol chairperson Archana Deshmukh in caste row
Top court stays Bombay High Court's interim relief to Katol Municipal Council chairperson Archana Deshmukh over her Kunbi caste validity certificate.
The dispute over Katol Municipal Council chairperson Archana Rahul Deshmukh's caste validity certificate has reached the Supreme Court, which has stayed the interim relief granted to her by the Nagpur bench of the Bombay High Court. The order clears the way for further legal action against her over the chairperson's post.
The dispute concerns Deshmukh's Kunbi caste validity certificate. The district caste certificate scrutiny committee had, on June 19, 2026, declared her Kunbi caste claim invalid. Deshmukh then challenged the committee's decision before the Nagpur bench of the Bombay High Court, which granted her interim relief, staying for the time being the implementation of the committee's order and any further orders and notifications based on it.
This relief was challenged in the Supreme Court by Kalpana Umap and others, rival candidates for the chairperson's post. The Supreme Court has stayed the High Court's interim order, giving the case a new turn.
Before the High Court, it was argued on Deshmukh's behalf that the caste scrutiny committee had not properly considered important old documents related to her family, as well as a vigilance squad report. According to available High Court records, old family records cited included references to Kunbi entries. The opposing side pointed to documents claiming some family records showed entries as Maratha. The High Court had also prima facie held that the scrutiny committee needed to properly consider certain important issues, and on this basis had granted interim protection against implementation of the committee's decision and related further orders.
In the Katol Municipal Council election, the chairperson's post was reserved for the OBC women's category. According to available court records, Archana Deshmukh had filed her nomination from this reserved category in the municipal council election held on December 2, 2025. The result was declared on December 21, 2025, and she won by a margin of about 2,300 votes. While filing her nomination, she had submitted an OBC Kunbi caste certificate and undertaken to submit a caste validity certificate within a stipulated period. The verification process of her caste claim then proceeded. After the committee's decision, the entire matter reached the courts and the validity of the chairperson's post also came into question.
Kalpana Umap and others approached the Supreme Court against the relief granted by the High Court. Senior advocate Mukul Rohatgi, along with advocates Mohit Khajanchi and Mahesh Dhatrak, argued the case on behalf of the petitioners. The Supreme Court has stayed the interim relief granted by the High Court and issued notice to the respondents concerned. The next hearing in the case has been fixed for November 3.
Following the Supreme Court's interim order, the possibility of further administrative and legal action regarding Archana Deshmukh's position as chairperson of the Katol Municipal Council has increased. However, the final outcome of the case is yet to be decided. The hearing on the original dispute will continue in the Supreme Court, with arguments and records from both sides to be considered further at the next hearing.
At present, the case centres on the caste validity certificate, the scrutiny committee's decision and its legal impact on the chairperson's post. The final position will become clear only after the court's further orders. The dispute over the chairperson's post is no longer confined to the caste certificate alone, and is likely to directly affect the leadership of the municipal council. Following the Supreme Court's latest order, political activity around the Katol Municipal Council has also increased, with attention now on the November 3 hearing.
